Perlis Mufti Dr Juanda Jaya says a rigid and complex procedure will encourage Muslim couples to elope to Thailand
KANGAR: The marriage procedure for Muslims in Malaysia, including for polygamous marriages and marriages to foreign spouses, should be simplified to reduce the number of marriages registered in south Thailand said Perlis Mufti Dr Juanda Jaya.
Juanda said a rigid and complex procedure would only encourage Muslim couples to seek an easy way out by eloping to Thailand.
“It is very easy to register a marriage in Thailand.
“And those with foreign partners, prefer to go over there as the procedures here are complicated.
“However, those who do so, put their marriage and spouses at risk as they will face problems in registering their marriages later here.
“Those with foreign spouses in Thailand, will have to verify the religious status of their partners.”
Juanda said the authorities should come up with a simpler procedure based on the four basic tenets of a Muslim marriage, to encourage Malaysians to marry here.
“I believe that as long as the spouses are Muslims, and the couple are capable of respecting each other’s feelings, and family background, they should be allowed to marry here,” he said.
Recently, the Malaysian Consul-General in Songkhla, Mohd Aini Atan, revealed that out of 3,260 marriages registered in southern Thailand last year, 782 involved Malaysians.
The highest number was between Malaysians and Thais (419), followed by Indonesians (228), Pakistanis (45), and Filipinas (18).
Malaysians had also registered marriages with spouses from Cambodia, South Africa, Singapore, France, Nigeria, South Korea, Japan, Afghanistan, Lebanon, Denmark, America, Iran, United Arab Emirates and Uzbekistan.
Besides the problem of the marriage being used as a ruse to obtain permanent resident status, there were concerns over the religious status of these foreign spouses as this details were not stressed by the Islamic marriage registrar in Thailand.

KUALA LUMPUR: Bimbang rahsia perkahwinan keduanya di negara jiran diketahui isteri pertama, seorang pengerusi sebuah pertubuhan kebajikan Islam di Ranau, Sabah sanggup meninggalkan isteri baru tanpa nafkah zahir dan batin hanya selepas beberapa bulan mereka bernikah.
Malah, lelaki berusia 50-an itu turut membiarkan isteri keduanya hidup tanpa status yang sah apabila enggan mendaftarkan perkahwinan mereka di sini walaupun mengetahui ia menyalahi undang-undang syariah.
Wanita malang itu yang hanya ingin dikenali sebagai Khadijah, 53, berkata, dia sanggup berkahwin dengan lelaki itu kerana terlalu mempercayainya yang mempunyai latar belakang agama tinggi dan berasa suaminya itu akan bertanggungjawab serta berlaku adil.
Menurutnya, mereka bernikah pada 30 Julai tahun lalu di Narathiwat, Selatan Thailand dan kira-kira sebulan selepas itu dia dengan usaha sendiri mendaftarkan pernikahan mereka di jabatan agama, namun suaminya enggan menandatangani dokumen dengan memberikan pelbagai alasan.
“Sebelum kahwin macam-macam dia janjikan, hingga sanggup memberi mas kahwin RM15,000. Tapi tidak sangka selepas tiga bulan bernikah dia meninggalkan saya tanpa sebarang nafkah serta turut bersikap dingin terhadap saya hingga kini. “Dia langsung tidak mempedulikan saya sekarang dan apabila ditanya mengapa, dengan selamba dia mengatakan mereka tidak boleh hidup bersama kerana cara hidup mereka berbeza,” katanya yang ditemui di sini, kelmarin.
Khadijah berkata, dia berasa dipermainkan dan lebih teruk suaminya seperti tidak mahu mengaku yang mereka sudah berkahwin dengan beberapa kali menghantar SMS mengatakan pernikahan di negara jiran itu tidak sah dan mereka tiada sebarang ikatan atau hubungan lagi.
Menurutnya, dia tidak sangka seorang berjawatan tinggi dalam pertubuhan Islam yang boleh dikatakan berstatus pendakwah serta mengetahui mengenai hukum agama serta undang-undang syariah tergamak melakukan perkara sedemikian. Katanya, dia kini malu untuk berdepan dengan masyarakat sekeliling terutama ahli keluarga dan rakan yang mengetahui mengenai perkahwinan mereka dan perkara itu juga mengganggu kehidupan hariannya.
“Jika benar dia sudah tidak mahu ada apa-apa hubungan, saya harap perpisahan itu dilakukan mengikut cara yang betul dengan mendaftarkan terlebih dulu perkahwinan dan kemudian barulah bercerai cara baik melalui proses yang betul.
“Macam mana nak bercerai sedangkan pernikahan kami tidak didaftarkan dan saya percaya dia mengetahui perkara itu, tetapi sengaja berbuat demikian kerana takut perkahwinan kami diketahui isteri pertama selain bimbang kedudukannya terjejas ekoran melakukan kesalahan mengikut undang-undang syariah ,” katanya.
Menurutnya, dia masih menyayangi suaminya dan jika boleh ingin mencari jalan terbaik bagi menyelamatkan perkahwinan mereka serta berharap suami lebih bertanggungjawab dengan tidak lepas tangan dengan apa yang sudah berlaku. Khadijah berharap agar pengalaman pahitnya itu dijadikan iktibar kepada wanita lain supaya tidak terpedaya dengan kedudukan seseorang itu hingga sanggup membelakangkan undang-undang.

'Marry second wife in Kelantan'

KOTA BARU: Local men who plan to take a second wife need not do it in Thailand as the syariah courts in the state will approve their applications for polygamous marriages, Kelantan Syariah High Court Chief judge Datuk Daud Mohamad said yesterday.
He said the court would also facilitate the marriage of couples whose parents would not give them consent to tie the knot.
He said it was not the practice of the syariah court to reject marriage applications without valid reasons.
"It is wrong to say that taking another wife or marrying without a wali cannot be done through our courts.
"However, we (syariah court) will run checks to determine if the man is capable to take a second wife before processing his application.
"If the first wife objects to her husband taking on another wife, we will also find ways to overcome the matter," he told reporters when met here yesterday.
Daud said a majority of Kelantan men chose to tie the knot in Thailand as they lacked knowledge and information about syariah court rules.
"Because of this, many of them especially young couples are easily influenced by marriage syndicates to tie the knot across the border.
"Syndicates which provide misleading information have caused couples to avoid going through proper marriage procedures as sanctioned by the syariah court."
Daud said many couples who had tied the knot in the neighbouring country regretted their decision later, including using the syndicates.
"They have expressed their regret to our religious officers when they realise that they have been cheated by the syndicates and also after they learnt that their marriages were invalid. They have told us that if they had avoided the services of the syndicates, they would have saved thousands of ringgit."
Daud said Kelantan men normally marry in southern Thailand such as in Pattani, Yala and Narathiwat.
He advised couples who planned to marry across the border to cancel their trip to avoid being cheated by the syndicates.
"They can check with our courts in all districts on the regulations for taking a second wife or marrying without a wali."

Births out of wedlock 'alarming'

PUTRAJAYA: The country is witnessing an increasing trend of children born out of wedlock with 234,674 cases recorded between 2006 and last year, the National Registration Department revealed.
Describing the situation as alarming, NRD director-general Datuk Alwi Ibrahim said last year alone, 52,982 children of the 510,462 births registered were born out of wedlock.
With the exception of last year, the number of cases increased in tandem with the number of births registered.
Based on NRD statistics, 38,258 out of the 472,983 births in 2006 were accorded illegitimate child status, the term used to refer to those born out of wedlock.
The figure surged to 44,234 out of 484,722 births in 2007; 46,822 out of 496,414 in 2008; and, 52,378 out of 516,645 births in 2009.
For Muslims, the illegitimate child status is given to babies whose parents have not performed the "akad nikah" (soleminisation) or those born less than six Qamariah months after the solemnisation, according to the National Fatwa Council.
For non-Muslims, the status applies to babies of unmarried mothers.
Of the three main races in the country, the statistics revealed, the trend was prevalent among the Malays, followed by the Chinese and Indians, respectively, from 2006 to 2008.
However, in 2009 and last year, there were more Indian babies born out of wedlock compared with the Chinese.
There was also a surge in the number of illegitimate children in the "Others" category, which lumps together all Malaysians who are not of the three major races, and foreigners.
"The increase in cases is not very significant when compared with the number of births registered, but still there is no drop in the figures," Alwi told the New Straits Times.
He said even though the NRD did not "zoom in" on the reasons why children were born out of wedlock when their births were registered, he attributed the trend to an increase in the country's population, the younger generation's exposure to unsavoury material, lack of awareness on birth registration laws as well as an influx of immigrants.
And while the department's job was only to register births, Alwi said the matter must be viewed seriously by all quarters.
Therefore, he said, it would inform the authorities, such as the Women, Family and Community Development Ministry and the Islamic Development Department, so that proper action could to be taken.
"Leaders, the community, relevant agencies, parents and schools must address this issue and see how best to tackle this problem. We all have a role to play.
"We need to have proper sex education so that individuals will fully understand the implications and responsibilities that come with sex."
Illegitimate Muslim children, Alwi added, would face complications under syariah.
