KUALA LUMPUR: Those who wish to practise polygamy without the consent of the first wife are advised to go through the proper channels to avoid from having entered an illegal marriage.
Selangor mufti Datuk Mohd Tamyes Abd Wahid said there were other legal ways to practise polygamy without the consent of the first wife.
Tamyes said Muslim men should not take their religion lightly and turn their backs on the law just because they did not have their wives' consent.
"If a man is keen on taking a second wife, he can go to court to prove that he is able to provide for his first and second wives as there are states where men can enter into a polygamous marriage without consent.
"They have to prove to the court that they are able, in the true sense of Islam, to take on a second wife.
"If their claim is true, the judge will issue an authorisation letter to the person," he said. Among the states where the consent of the first wife is not needed are Perlis and Kelantan.
On the validity of a marriage with consent obtained through a phone call from the bride's guardian (wali), Tamyes said it would not be a problem as long as consent was obtained from her legal guardian.

PUTRAJAYA: The Malaysian Anti-Corruption Commission (MACC) has uncovered a syndicate providing false marriage certificates to polygamous men.
The syndicate, offering services to men who wanted to marry more than once without having to go though the legal procedures, was exposed in MACC's Ops Madu ,conducted five days ago.
A MACC insider said four people, including an Islamic Development Department (Jakim) officer, were arrested in three raids in Danau Kota, Wangsa Maju and Gombak, all in the Klang Valley.
One of the suspects, serving as the marriage official, was solemnising a couple in his house during a raid.
The MACC also interrogated two others in the raid, including a disabled person who was responsible for "producing" the marriage certificates.
It is learnt that legal guardians of couples need not be present at the syndicate's marriage solemnisation, which could be done by phone.
Such marriage solemnisation were conducted in budget hotels or in the home of couples who need only produce two copies of their photographs, identification cards and the identification card of a witness. The syndicate was believed to have charged each couple between RM1,600 and RM2,300. It is learnt that the syndicate had conducted 500 "marriages" since 2000.
The suspects, aged between 50 and 64, were remanded since Feb 13 but were released yesterday morning.
