SEREMBAN: A 22-year-old man who was convicted of raping his underage girlfriend had his four-year jail term increased to five by the High Court here.
Judicial commissioner Datuk Ahmad Nasfy Yasin in increasing the sentence of Mohamed Haffis Shahrom said: "Social ills among youths are a common problem nowadays.
"Incidents of dumping newborn babies happen almost every day.
"Therefore, I order the accused to serve a total of five years' jail from today."
Haffis' counsel Ram Karpal Singh then applied for a stay of execution as the defence would be filing an appeal.
Ahmad Nasfy allowed the application on the condition that the accused presented himself at the nearest police station once a month.
Haffis, from Felda Raja Alias, Jempol, was charged with raping his girlfriend, then aged 15, at the Sprintest race track in Jalan Serting Hilir, at 8.30pm in June 2007.
According to the evidence, four months after the alleged offence the victim's elder sister noticed a change in her sister's physical appearance and informed their mother.
The victim's mother then confronted the victim who told her that she was pregnant.
The mother later took the victim to a clinic and the pregnancy was confirmed.
The victim's family was said to have asked the accused to take responsibility for the unborn child by marrying their daughter.
However, they imposed conditions of a RM50,000 fixed deposit if he married her or a lump sum of RM100,000 if he refused.
When the accused was unable to meet either one of the conditions, the victim's family lodged a police report against him.
On March 27, 2008, the victim delivered a baby girl, and a chemist's report confirmed that the accused was the biological father of the baby.
He was charged at the Kuala Pilah Sessions Court, found guilty and sentenced to four years' jail on Dec 8 last year.
